Terms of Service
These terms govern your use of the Zothey marketplace. Please read them carefully, by creating an account or using Zothey, you agree to them.

1. Who we are and what Zothey is
Zothey operates an online marketplace that connects customers planning a wedding with independent wedding businesses ("suppliers"). Zothey provides the platform: the listings, messaging, booking, calendar, planning tools and payment processing. Zothey does not supply the goods or services listed on it. Contracts for goods and services are formed directly between the customer and the supplier.
2. Accounts
You must be at least 18 years old and able to enter into a legally binding contract to create an account. You must give accurate information, keep your login details secure and tell us promptly if you believe your account has been accessed without your permission. You are responsible for activity carried out through your account.
3. Using Zothey as a customer
Zothey is free for customers. You may browse listings, save favourites, message suppliers, request quotes, book appointments and place orders. When you place an order or accept a quote, you enter into a contract with the supplier on the terms shown at the time, and you agree to pay the amounts stated, including any deposit and balance.
Prices, availability and descriptions are provided by suppliers. We take reasonable steps to review listings, but we do not independently verify every claim, image or price, and we do not guarantee that a listing is error-free or that a supplier will be available on your date.
4. Using Zothey as a supplier
Suppliers must apply and be approved before trading. You must be a genuine business, provide accurate business details, hold any licences, registrations and insurance your trade requires, and comply with all laws that apply to you, including consumer protection, pricing transparency, advertising standards, health and safety and tax obligations.
You are solely responsible for your listings, your prices, the accuracy of what you publish, fulfilling what you sell, and dealing fairly with customers. You must respond to enquiries within a reasonable time, honour quotes you send while they remain valid, and keep your availability up to date. We may review, edit, pause, reject or remove listings that breach these terms, our published standards or the law.
5. Plans, fees and payouts
Suppliers subscribe to a plan. Depending on the plan, charges may include a recurring subscription fee, a monthly fee per live listing, a percentage marketplace fee on each sale, a fixed fee per item sold, and payment processing costs. The applicable amounts are shown before you subscribe and in your billing area. All fees are payable in pounds sterling and, unless stated otherwise, are exclusive of VAT, which will be added where required.
Where a free trial is offered, it converts to a paid subscription at the end of the trial unless cancelled first. Subscriptions renew automatically until cancelled. Cancelling stops future renewals; it does not refund fees for a period already started, except where the law requires otherwise.
Customer payments are collected through our payment provider. Suppliers must complete payout onboarding and identity checks before funds can be released. We may withhold or delay a payout where a transaction is disputed, suspected to be fraudulent, subject to a refund or chargeback, or where required by law. We may set off amounts you owe us against amounts payable to you.
6. Cancellations, returns and refunds
Consumer cancellation and refund rights, including any statutory right to cancel a distance contract, apply to the contract between the customer and the supplier. Suppliers must publish and honour clear cancellation, deposit and refund terms that comply with UK consumer law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Certain items and services, including goods made to your specifications or clearly personalised, and services already fully performed with your agreement, may be excluded from the statutory cancellation right. Deposits for booked dates may be non-refundable where the supplier's published terms say so and that term is fair.
We may facilitate refunds through the original payment method as part of our dispute process, but we are not the supplier and do not accept liability for a supplier's refusal to refund. Nothing in these terms limits your statutory rights.
7. Reviews and content you post
Reviews may only be left by customers who actually ordered or booked through Zothey. Reviews must be honest, based on genuine experience and free of unlawful, abusive or misleading content. Suppliers must not write, buy, incentivise or solicit fake or misleading reviews, and must not offer benefits in exchange for a positive review. We may remove content that breaches these rules and suspend accounts responsible for it.
You keep ownership of content you upload. You grant Zothey a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for formatting and display that content for the purpose of operating and promoting the marketplace. You confirm that you own the content or have the rights necessary to grant this licence.
8. Acceptable use
You must not use Zothey to break the law, infringe anyone's rights, post false or misleading information, harass anyone, scrape or harvest data, attempt to gain unauthorised access to systems or accounts, introduce malicious code, or interfere with the platform's operation. You must not take transactions off-platform to avoid our fees or to circumvent our protections.
9. Intellectual property
The Zothey platform, name, logo, design and software are owned by Zothey or its licensors and are protected by intellectual property law. You may not copy, modify, distribute, sell, licence or create derivative works from them without our written permission.
10. Availability of the service
We aim to keep Zothey available and working properly, but we do not guarantee uninterrupted or error-free access. We may change, suspend or withdraw features, carry out maintenance, or restrict access where necessary to protect the platform or its users.
11. Suspension and termination
You may close your account at any time. We may suspend or terminate an account, remove listings or withhold payouts where we reasonably believe there has been a breach of these terms or the law, a risk of harm to users, or fraudulent activity. Where we do so, we will tell you the reason unless we are prevented from doing so by law. Obligations that have already accrued, including payment obligations, survive termination.
12. Our liability
Zothey is not a party to the contract between a customer and a supplier and is not responsible for the quality, safety, legality, timing or performance of goods or services supplied. We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited.
Subject to that, we are not liable for losses that were not foreseeable, for losses caused by your own breach of these terms, or, where you use Zothey for business purposes, for loss of profit, business, contracts, goodwill or anticipated savings. Where you use Zothey as a business, our total liability arising out of or in connection with these terms is limited to the fees you paid us in the 12 months before the claim arose.
13. Changes to these terms
We may update these terms to reflect changes to the service, our fees or the law. Where changes are material we will give reasonable notice before they take effect. Continuing to use Zothey after the changes take effect means you accept them.
14. Governing law and disputes
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you live in Scotland or Northern Ireland you may also bring proceedings in the courts of the country where you live. If you have a complaint, please raise it with us first through our contact page so that we can try to resolve it.
15. Other terms
If any part of these terms is found to be unenforceable, the rest continues to apply. Our failure to enforce a term is not a waiver of it. You may not transfer your rights under these terms without our consent. These terms, together with our Privacy Policy, form the whole agreement between us about your use of Zothey.
